A new bill authored by State Rep. Metcalf in the Texas House seeks to mandate coverage of medically necessary anesthesia during dental procedures for young children with documented health needs, according to the Texas Legislature website.

The bill on Taxation category, introduced as HB 261 during the 89(2) legislative session on Tuesday, Aug. 19, was formally listed with the short title: ’Relating to a limitation on increases in the appraised value of certain commercial real property for ad valorem tax purposes’.

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill adds Subchapter G to Chapter 1367 of the Texas Insurance Code, mandating that health benefit plans covering medically necessary general anesthesia services cannot exclude these services when related to dental procedures for individuals under 13 who require anesthesia due to documented physical, mental, or medical reasons. However, the bill does not require the plans to cover dental care or procedures themselves. This legislation applies to a wide range of health plans, including those offered by insurance companies, health maintenance organizations, and various coverage types under specific chapters. The provisions will only affect plans delivered, issued for delivery, or renewed on or after Jan. 1, 2026, with the bill becoming effective on Sept. 1, 2025.

Will Metcalf, the chair of the House Committee on Culture, Recreation & Tourism, proposed another three bills during the 89(2) legislative session. He is also a member of the House Committee on State Affairs and the vice chair of the House Committee on S/C on Telecommunications & Broadband.

Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
