In essence, this bill amends the Texas Penal Code to address the offense of endangering a child, elderly individual, or disabled individual through certain actions involving controlled substances. It presumes a person endangers these vulnerable groups if they manufacture, possess, or introduce methamphetamine or substances in Penalty Group 1-B in their presence, or if the presence of these substances is detected in the blood, urine, or other bodily substances of the vulnerable individuals due to the accused’s conduct. Additionally, injecting, ingesting, inhaling, or otherwise introducing these substances into the body without lawful possession also constitutes endangerment. The changes apply to offenses committed on or after Sept. 1, 2025.
